Stay Summit Rental Terms and Conditions
 

These Terms & Conditions are for reference only; all items may not apply to all our properties. In addition, some of our properties may have more Terms & Conditions that are not shown below. For specifics on each property's Terms & Conditions, enter your arrival & departure dates and look for the Terms & Conditions on the individual properties' checkout pages.

  1. RENTAL PROPERTY. Tenant agrees to rent from Stay Summit the premises herein referred-to as the “Rental Property”. 

  2. TERM. Unless a specific agreement indicating otherwise has been reached, the term will commence on Arrival Date at four o’clock (4:00) PM, and continue until Departure Date at ten thirty (10:30) AM.  Tenant agrees to check in after 4:00 PM on Arrival Date and check out before 10:30 AM on Departure Date. 

  3. USE.  The premises will be used as a temporary residence for no more than 8 persons. 

  4. PARKING.  Tenant understands that there is sufficient parking for up to two vehicles, including one in the attached garage and one in front of the attached garage with the front or rear bumper within 3 feet of the garage door.  Excess vehicles must not be parked in the driveway or on the public roadway or elsewhere in the subdivision.  Recreational vehicles, motor homes, campers, trailers, etc. may not be parked in the driveway or roadway at any time.  Stay Summit does not guarantee that Tenant’s vehicle will fit in the attached garage; if Tenant’s vehicle does not fit in the attached garage, Tenant agrees that only one car may be parked outside the property. Vehicles not parked in accordance with these terms may be towed at any time, at Tenant’s expense, without warning. 

  5. PARTIES.  No parties shall be held on the premises without the prior written consent of Stay Summit.  No more than 12 persons shall be present on the premises at any time.

  6. DOWN PAYMENT.  A down payment of 25% of the total charges is required by credit card at the time of booking.  The down payment is fully applicable to the rent.  The balance is due 30 days prior to arrival.  Upon timely receipt by Stay Summit of the down payment and acceptance of the Short Term Rental Agreement or Terms and Conditions, the Rental Property will be reserved for Tenant for the Term.  The reservation is not confirmed until a Confirmation or Deposit Receipt email is sent to Tenant by Stay Summit.

  7. FINAL PAYMENT.  The balance of the total charges is due by check 30 days prior to the Arrival Date.  All credit card charges for the final payment are subject to an additional 2.5% fee.  Stay Summit will email a final payment reminder to Tenant approximately 37 days prior to arrival.  If final payment is not received 21 days prior to arrival, Tenant hereby authorizes Stay Summit to charge the final payment to Tenant’s credit card on file, plus a 2.5% fee.

  8. CANCELLATION.  If notice of cancellation is received by Stay Summit 45 days or more prior to Arrival Date, 50% of the down payment, but not less than $250, is nonrefundable.  If cancellation is received less than 45 days but more than 30 days prior to the Arrival Date, the down payment is nonrefundable.  If cancellation is received 30 days or less prior to the Arrival Date, the full amount of the reservation including all taxes, fees, and add-ons is nonrefundable.  Other than the refund policy outlined herein, no refund will be given as a result of any weather, ski, or road conditions.

  9. VACATION RENTAL DAMAGE PROTECTION. As a part of your stay, you may purchase $3,000 in vacation rental damage protection designed to cover unintentional damages to the rental unit interior that occur during your stay, provided they are disclosed to management prior to check-out. If purchased, the protection covers a maximum of $3,000 in damage. Any damages that exceed $3,000 will be charged to the credit card on file. If you damage the real or personal property assigned to your rental accommodation during the trip, we will reimburse the lesser of the cost of repairs or the replacement of the property, up to $3,000. Certain terms and conditions apply. Vacation rental damage protection can be purchased up to, and including at, check-in.   By submitting payment for this plan, you authorize Stay Summit to cover any amount payable under the terms and conditions of the vacation rental damage protection.  Please contact Stay Summit directly if you do not wish to participate in this assignment.

  10. SECURITY DEPOSIT.  If Vacation Rental Damage Protection is not purchased, Tenant agrees that Stay Summit may charge $3,000 on Tenant’s credit card.  Said funds will be held in a non-interest-bearing account.  Refunds, less the cost to replace, repair, or restore damages (at the sole discretion of Stay Summit) will be refunded within 14 days of departure.

  11. FURNISHINGS INCLUDED.  The rental includes typical household furnishings and appliances.  If Tenant moves furnishings, Tenant agrees to move furnishings back to their original positions.

  12. TELEPHONE.  Tenant understands that there may be no telephone on the premises.  Tenant is highly encouraged by Stay Summit to bring a cellular phone for emergencies and to familiarize himself or herself with the local emergency telephone numbers.

  13. ANIMALS.  No animals will be brought on the premises without prior consent of Stay Summit.

  14. SMOKING.  Tenant or his or her family, invitees, or guests will not smoke or “vape” tobacco or any other product, legal or illegal, anywhere inside or around the structure, including any garage, decks and common areas.  Smoking inside the unit will result in a $500 charge plus all necessary cleaning and odor elimination costs.

  15. MINIMUM AGE.  Tenant represents that Tenant is at least 25 years of age.

  16. CLEANING.  The Rental Property will be clean upon Tenant’s arrival.  Daily and/or periodic cleaning will not be provided by Stay Summit.

  17. LINENS.  Sheets and towels will be provided for Tenant’s use.  Linens will not be replaced by Stay Summit during the term; however, replacement linens may be provided by Stay Summit upon Tenant’s request at Tenant’s expense.  All linens in the Rental Property belong to Stay Summit; they do not belong to any building or owner’s association.  Lost, stolen, or damaged towels will be billed against Tenant’s security deposit at the following rates:  Bath towels $15 each; hand towels $10 each; washcloths $5 each.  Linens will be considered damaged if they are excessively dirty, such as if they have been used to clean bicycles, muddy boots, or auto parts.

  18. VACATION RENTAL INSURANCE.  CSA Vacation Rental Insurance has been made available with your reservation. Vacation Rental Insurance reimburses for pre-paid, non-refundable expenses due to certain unforeseeable circumstances that may jeopardize your vacation investment and force you to incur unplanned expenses.  We strongly recommend you purchase this valuable protection.  If declined, you acknowledge you have read and understand our cancellation policy and choose not to purchase Vacation Rental Insurance on behalf of all occupants.

  19. ORDINANCES AND STATUTES.  Tenant will comply with all statutes, ordinances, and requirements of all municipal, state, and federal authorities in force regarding the use of the premises.

  20. ASSIGNMENT AND SUBLETTING.  Tenant will not assign this Agreement or sublet any portion of the premises without prior written consent of Stay Summit.

  21. MAINTENANCE AND DAMAGE.  Tenant acknowledges that, unless Stay Summit is notified immediately upon occupancy, the premises, including the furniture, furnishings and appliances, are in good working order and repair.  Tenant will keep the premises in a clean and sanitary condition, and will immediately notify Stay Summit of any damage to the premises or its contents, or any inoperable equipment or appliances.  Tenant will surrender the premises, at termination, in as good condition as received, normal wear and tear excepted.  Tenant will be responsible for any damage caused by Tenant or his or her family, invitees, and guests.  Tenant will not commit any waste upon the premises, or any nuisance or act which may disturb the quiet enjoyment of any other occupant in the complex.  It is understood that Stay Summit’s insurance does not cover Tenant’s personal property.

  22. ENTRY AND INSPECTION.  Stay Summit will have the right to enter the premises: (a) in case of emergency; (b) to make necessary or agreed repairs, decorations, alterations, improvements, supply necessary or agreed services, show the premises to prospective or actual workers or contractors; (c) when Tenant has abandoned or surrendered the premises.  Except under (a) and (c), entry may be made only during normal business hours, and with at least 24 hours prior notice to Tenant.

  23. INDEMNIFICATION.  Stay Summit will not be liable to any damage or injury to Tenant, or any other person, or to any other property, occurring on the premises, or in common areas, unless such damage is the legal result of the negligence or willful misconduct of Stay Summit, its agents, or employees.  Tenant agrees to hold Stay Summit harmless from any claims for damages, no matter how caused, except for injury or damages caused by negligence or willful misconduct of Stay Summit, its agents, or employees.  Stay Summit pays for periodic snow removal through the homeowners’ association; Stay Summit is not responsible for any lateness thereof or missed spots.  Tenant understands that alpine conditions exist in Breckenridge, and some snow, icicles, and icy spots are likely to exist on and around the premises. 

  24. WEATHER.  Tenant understands that the weather in Colorado is unpredictable.  Other than the cancellation policy outlined herein, no refund will be given as a result of any weather, ski, or road conditions.  No refund will be given for any excess or lack of snow.

  25. WAIVER.  Failure of Stay Summit to enforce any provision of this Agreement will not be deemed a waiver.

  26. UNAVAILABILITY OF ACCOMMODATIONS. In the event that the Rental Property is unavailable for any reason beyond the control of Stay Summit (including, without limitation, fire, water damage, mechanical systems failure, or natural disaster), and if Stay Summit cannot secure comparable accommodations for Tenant, Stay Summit shall refund the prorated rental cost including taxes, fees, and add-ons to Tenant, and this Agreement will thereupon be deemed terminated. In no event shall Stay Summit be liable beyond the return of any payment made by Tenant.

  27. FAILURE OF APPLIANCES/MECHANICAL SYSTEMS. No refund will be given to Tenant for failure of any appliance(s), hot tub, or mechanical system (boiler, water heater, etc.) unless the property is physically uninhabitable as a result of such failure.  However, Landlord shall make a good-faith effort to repair the failure as quickly as possible.

  28. DISPUTE.  In the event that any action or legal proceedings become necessary to settle a dispute between Stay Summit and Tenant arising out of this Rental Agreement, then the parties hereto agree that Summit County, Colorado is the county and state of jurisdiction and venue.  Summit County, Colorado is the county and state and in which all contractual agreements have been made and in which payments are being (or have been) rendered.

  29. FAIR HOUSING.  Stay Summit and Tenant understand that the state and federal housing laws prohibit discrimination in the sale, rental, appraisal, financing or advertising of housing on the basis of race, color, religion, sex, sexual orientation, marital status, national origin, ancestry, familial status, source of income, age, mental or physical disability.

  30. ENTIRE AGREEMENT.  The foregoing constitutes the entire agreement between the parties and may be modified only in writing signed by all parties.  If there is more than one Tenant, all Tenants are jointly and severally liable under this rental agreement.

  31. INDIVIDUAL OWNERS: All of the properties under Stay Summit’s control are independently owned.  All protections and indemnifications provided to Stay Summit by this Agreement shall also apply to the individual property owner(s).
